The following Terms and Conditions have been prepared for membership and classes at MAHÉ YOGA.
MAHÉ YOGA – Terms & Conditions of Use
1. interpretation and variation
1.1
In the Terms & Conditions the following definitions apply:
Company or The Studio means MAHÉ YOGA. Member/Studio User means any person that has signed a Registration Form or ticket the Waiver box online which has been accepted by Mahé Yoga. Registration Form means the registration & application form signed by each Member. Studio means any of Mahé Yoga as published on our website(s) from time to time. Terms & Conditions as defined here.
Website means www.mahestudio.nl, www.maheyoga.com, or affiliated websites. If you are a member with us or want to become a member with us and use our services or products, we like to have clear and transparent arrangements in place. By registering, you declare that you accept these terms and conditions and the house rules of Mahé Yoga and that you will act in accordance with them.
1.2
The Terms & Conditions are incorporated into the Registration Form & online booking system.
1.3
The Company reserves the right to vary or revoke any of the Terms & Conditions from time to time which it may consider necessary or suitable for the regulation of the governance of Mahé Studio & the conduct of Members. Any such changes will be published on our websites &, until revoked, are binding on Members.
1.4
The Terms & Conditions shall be governed by the laws of The Netherlands & subject to the exclusive jurisdiction of the Dutch courts.
2. membership / studio user
2.1
Subject to condition 2.2, when a person has signed a registration form or ticked the terms & conditions online they shall become a Member of the Studio or a studio user.
2.2
Acceptance of a person as a Member or a studio user is at the discretion of Mahé Yoga.
2.3
Mahé Yoga reserves the right to withdraw, suspend or refuse to renew the membership of any Member or User whose conduct is, or may deemed to be in the Company’s reasonable opinion, injurious to the character of the Studio or amounts to a breach of the Terms & Conditions or where such expulsion is otherwise to be in the interests of the other Members of the Studio. Any Member so expelled shall forfeit all privileges to membership & shall not be entitled to any refund for any period during which his membership is suspended.
2.4
Mahé Yoga may run promotional introductory offers from time to time. These offers are exclusively for new students who are not already registered (Members/Users) with the Studio & are not for repeat use.
3. studio opening times
Details of class times at Mahé Yoga may vary from time to time. Class times will be published by the Studio on our Website. Studios are open 15 minutes before and after class.
4. payment terms
4.1
Details of class prices, class card prices and memberships are available on our website(s) or shall be such prices as determined by Mahé Yoga from time to time.
4.2
The credit or debit card of members will be held on file and will be charged each month. That is the date they are first charged, not the first day of the month.
4.3
Failure to pay membership fees - whatever the reasons - will result in a penalty of €100,- times the month that they missed their payments.
4.4
At Mahé, we understand that mistakes can happen, and sometimes there are billing errors from credit card/debit card companies. If you dispute a charge without first contacting us at Mahé, you may likely win the dispute, but it can result in a financial penalty for our small business from the online payment processor. This fine could have a significant impact on us.
If you encounter such a situation, we kindly ask you to reach out to us via email with the subject line: Unauthorized Debit. We will investigate the matter promptly within 72 hours. During this time, we urge you not to take matters into your own hands by requesting a chargeback from your bank account, as it could incur a €15 fine for Mahé from the payment processor. If you proceed with the chargeback despite our advice, Mahé reserves the right to take further action, including initiating the collection of owed funds, imposing a fine, and/or terminating the membership.
Your cooperation and understanding in this matter are greatly appreciated as we strive to resolve any issues together in a fair and efficient manner. If you have any questions or concerns, please don't hesitate to reach out to us.
4.5
Limited Memberships are those who are currently holding 1x per week and 2x per week subscription.
Unlimited Memberships are those who are currently holding Unlimited Monthly subscriptions.
4.6
Payments for classes at Mahé Yoga do not entitle you to attend classes of any other yoga Studio other than those operated by this Company (in the event that they are available).
4.7
Subject to any statutory right of cancellation, payments for classes, class card fees, monthly subscription fees & annual payments are made non-refundable unless stated otherwise on these terms & conditions.
4.5
Workshops & Programs/Events at Mahé Yoga Studio are non-refundable. They can be credited to account if notice is given with a minimum of 3 days prior to the workshop date due to unforeseen circumstances (exceptions made for certain medical/personal circumstances at the Company’s discretion). Deposits however are non-refundable.
5. monthly autopay
5.1
The provisions of this clause shall only apply to Members that subscribe to Unlimited and Limited classes by monthly (Subscription).
5.2
Members shall be given no less than 30 working days’ written notice of any increase in their Subscription (unless otherwise agreed in their contract).
5.3
A Member may cancel their Subscription at any time after the minimum Subscription contract period, by written request to yogawithpritha@gmail.com, giving a one month notice before the next renewal date.
5.4
Members agree & acknowledge that by agreeing to the minimum Subscription contract period of one year (12 months), they are being given preferential rates by Mahé Yoga & therefore it is fair & reasonable that the Company charges them for any payments as described & referred to above.
5.5
Members agree & acknowledge that as soon as they have passed the minimum subscription contract period of one year (12 months), they may experience price increase within three (3) months.
5.6
Members who have agreed to commit to another contract renewal after the minimum subscription period, they are being given preferential rates by Mahé Yoga and this Company will honor the agreed rates for the next 6 months, 9 months or one year - according to their contract.
5.7
Members who do not wish to accept a change proposed by the Company to the Terms & Conditions or to pay an increase in any Subscription fees may cancel their Subscription by giving written notice to the Studio. The notice must be given before or within 30 days after the change to the Terms & Conditions or increase in subscription fees takes effect & must expire at the end of the relevant calendar month. The Member giving notice must continue to pay subscriptions at the current rate immediately prior to any proposed increase until the end of such notice period.
6. temporary transfer
6.1
Limited & Unlimited members are given an option to temporarily transfer their subscription to another person (who is not a member of Mahé Yoga) for the period of maximum three (3) weeks within one (1) year period - while they are away on holiday.
7. pausing membership due to health issues
7.1
Pausing membership due to health issues is meant as a way to stop billing to Mahé Yoga for a particular period of time and then resume them when you are healthy again.
7.2
Limited & Unlimited members have the rights to pause their memberships due to health issues less or more than three (3) weeks within one (1) year period if members can show an official letter from their healthcare practitioner that shows that this member will not be able to follow any activities offered by Mahé Yoga for a certain period of time. This medical certificate must contain the full name of the members, reasons that the practice of Yoga in general including meditation and breathing is not advised to be done by the members, and the duration the members should not practice Yoga in general including meditation and breathing. Without this official letter from their healthcare professional, the request to pause membership will not be granted, the member will be charged as usual despite their inability to attend all classes provided by Mahé Yoga. For the processing of the pausing membership, you will be liable to pay a one-off administrative fee of €10.
7.3
Members who have been providing a medical certificate that indicates that members are no longer to practice Yoga in general including meditation and breathing, for a period of at least 12 months from the date of issuance of the medical certificate, Mahé Yoga will have the right to cancel the membership 30 days after the issuance of the medical certificate. Members will be charged one-more time of their current subscription plus a one-off administrative fee of €10.
8. ending the membership
8.1
Ending the membership means that members no longer want to continue having the same membership at Mahé Yoga.
8.2
To end the membership, the member must send an email to yogawithpritha@gmail.com one calendar month in advance, with the subject of: Termination of Membership. The membership will be ended one month after the email sent responded by Mahé Yoga that an additional billing cycle will occur before the cancellation is effective, and the members will be emailed with a notification. Members will still be able to come to Mahé Yoga using that same membership that is due to end, until the very last day mentioned on the first email confirmation notification sent by Mahé via email.
9. personal belongings
Personal belongings are brought into the Studio premises at the Member’s risk & Mahé Yoga does not accept liability for any loss or damage whatever to such items. For security reasons Members are advised to place personal belongings in the space provided.
10. facility bookings
10.1
Early Cancellations– If you cancel more than 2 hours before the start of a regular daily Yoga class no fee is applied. This allows waitlist students to be contacted & join the class.
10.2
A ‘Late Cancellation’ (cancelling a class within the 2 hours period) will incur the following:
• Drop in students: If you have pre-paid for your class you will lose the class you have paid for.
• Classpass/Rittenkaart/Limited membership students: If you cancel a class too late for a booked class you will lose the class you have paid for.
• Unlimited Members: For a 'Late Cancellation' as an Unlimited member you will be charged €10,-
10.3
A ‘No Show’ (failure to turn up for a class at all without prior cancellation) will incur the following:
• Drop in students: If you have pre-paid for your class you will lose the class you have paid for.
• Classpack/Rittenkaart/Limited membership students: If you do not show up for a booked class you will lose the class you have paid for.
• Unlimited Members: For a no-show as an Unlimited member you will be charged €10,-
10.4
Our Online Booking Facilities & Rules are as follows:
• Classes can be booked online up to 2 weeks in advance.
• All students with online bookings register at least 3 hours before the class starts.
• All students with online bookings must sign in at least 10 minutes before the class starts.
• When classes have reached their online booking capacity you can add yourself to the waitlist.
• If you are on the waitlist you will automatically be allocated a space in the class once a spot becomes available.
• Our booking system will email you a notification.
11. reiki 1 & 2 trainings/courses
11.1
Registrations – Registration for Reiki trainings closes 24 hours in advance.
• The waiting list for this course ends 48 hours in advance.
• We need a minimum of 6 participants for this course to take place (unless stated otherwise). You will be informed whether the Reiki trainings will go ahead 24 hours in advance.
11.2
Cancelations
• Any cancellations from your part, regardless of the reason, as long as the cancellation is given at least 72 hours in advance, gives you the option of receiving a refund in the form of a 'credit' for a subsequent event.
• If you cancel within 72 hours, you will not receive a refund in any form. Your investment will be lost.
• Cancellations from Mahé Yoga, regardless of the reason, give you the opportunity to receive a refund in the form of Money Credits in your Momence account, that you can use towards future trainings, workshops or daily classes.
• There is a minimum of 6 participants for this event to take place (unless stated otherwise). If we do not meet this number, the event will be canceled and you will be notified via email 24 hours in advanced and we will arrange the refund into your Money Credits.
12. use of facilities
12.1
A Member is entitled to use the Studio’s facilities during scheduled class times providing always that the Studio may at any time withdraw all or part of its facilities for any period or periods & with notice, where practicable, in connection with any leaning, repair, alteration or maintenance work or for reasons beyond the control of the Studio or the Company.
12.2
Children under the age of 16 may only use the Studio & attend classes if accompanied by an adult & when under their care & supervision, however the Studio reserves the right of refusal for any minor to practice according to clause 9.1
13. fitness & health
13.1
Members are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition. Mahé Yoga reserves the right to refuse access to any Member if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of such facilities.
13.2
Members with the following conditions should consult a doctor: low/high blood pressure & cardiac irregularities. If there is any doubt, the Member should consult his doctor. Members & their guests must notify Mahé Yoga of any circumstances affecting their health which may be exacerbated through continued use of the Studio.
13.3
Members are required to follow the instructions of the teacher at all times.
14. dress & footwear
14.1
Members are requested to wear a form or dress appropriate to the practice of Yoga classes. Footwear should be removed on entry to the studio’s.
14.2
Members are requested to wear layers during cold seasons / winter time to keep themselves warm. Mahé Yoga will turn the heaters on when it's 10 degrees and less. Until then, each member or studio user is responsible for their own well-being to stay warm and cozy.
15. safety & hygiene
15.1
Smoking is not allowed anywhere in the studio. Please avoid using spray deodorants, hairspray’s etc, to avoid bothering fellow students.
15.2
In the event of a fire, Members are asked to make their way to the nearest available exit and in orderly manner.
15.3 For hygienic reasons, please take a shower before attending any Yoga classes.
16. general guidelines
16.1
Members must at all times observe Mahé Yoga's guidelines which may be notified to them from time to time & are requested to comply with any reasonable directions which the management of the Studio may issue to ensure the smooth operation of the Studio for the convenience of all Members.
16.2
Members are required to give written notice to Mahé Yoga of any change of address, email or contact number. Failing such notice, all communications shall be assumed to have been received by the Member within 5 days of mailing to the last address notified to the Company.
16.3
Mahé Yoga reserves the right to refuse admission to the Studio.
16.4
Mahé Yoga may, if a Member so wishes, communicate with the Member by email. By providing an email address to the Company the Member consents to receiving email communications from the Company, including notices pursuant to the Terms & Conditions. The Member also accepts any risk that email may not be a fully secure & confidential means of communication. The Company will not be liable for any loss or damage suffered as a result of communicating with a Member in this manner.
16.5
Studio facilities are provided for use immediately before and after class. Studio’s are open 15 minutes before and 15 minutes after class.
16.6
In order to ensure all participants enjoy a calm & relaxing environment, we ask that you arrive 5-10 minutes prior to the start time of class to get organized. Doors will lock promptly at the scheduled event time and we will be unable to accommodate late arrivals. We do not accept any text messages/whatsapp/emails that announces your LATE ARRIVALS. At this stage Mahé only take phone calls.
17. limitation of liability
17.1
Mahé Yoga cannot be held responsible for any service or equipment not being available for whatever reason. Mahé Yoga reserves the right to make alterations to the types of facilities provided, without notice & in its absolute discretion. The Company shall not be liable for any loss occasioned by such alterations except in so far as loss is by law incapable of exclusion.
17.2
It is the Member’s responsibility to ensure that they are capable of undergoing a routine of exercises provided by any programme that they follow or class that they attend. Members accept the risk of injury from performing exercises & are advised to consult their doctor prior to beginning any program or class. Mahé Yoga accepts no liability for loss or damage to property or injury of Members or their guests to them on the Studio premises or outside the Studio except in so far as such loss, damage, or injury is by law incapable of exclusion.
18. website terms & conditions
Information published on Mahé Yoga's website is provided for the use of its visitors & you are advised that, although care has been taken to ensure technical & factual accuracy, some errors may occur. No guarantee is given of the accuracy or completeness of information on these pages. Please be aware that Mahé Yoga may alter the information on its web site from time to time. Mahé Yoga shall have no liability arising from the use by any party of the information on this web site. Mahé Yoga does not warrant the information on this web site in any way & in particular no warranty is given that the web site or its contents or hypertext links are virus free or uncontaminated. You are advised to make your own virus checks & to implement your own precautions in this respect. Mahé Yoga excludes all liability for contamination or damage caused by any virus or electronic transmission.
19. booking software
19.1
Mahé Yoga is currently using a 3rd party booking software called Momence (or used to be called Ribbon Experience).
19.2
All students, members, and clients of Mahé Yoga can download Momence Software into their smartphone to make the booking process easy and accessible. Momence can also be accessed via Mahé Yoga website under Schedule pages.
20. privacy & security policy
Your personally identifiable information is kept secure. Only authorized employees, agents & contractors (who have agreed to keep information secure & confidential) have access to this information. All emails & newsletters from our sites allow you to opt out of further mailings.
